Terms of Service

1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of Ark Agency (the "Service"), a content operations platform for video production teams. By creating an account or using the Service you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
2. The Service
The Service provides tools for managing content production — including content pipelines, client management, briefs and scripts, approvals and feedback, shoot and meeting scheduling, team calendars, and time tracking. We may add, change, or remove features as the Service evolves.
3. Accounts
You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at filipbonce@gmail.com if you suspect unauthorized use of your account.
4. Workspaces and your content
Content you or your team submit to the Service — clients, briefs, scripts, content pieces, schedules, feedback, and similar material ("Your Content") — remains yours. You grant us a limited license to host, store, process, and display Your Content solely as needed to operate and provide the Service.
Content in a workspace is visible to that workspace's members according to their roles. Workspace owners and administrators control membership and roles, and are responsible for who they invite.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Upload content that infringes the intellectual property or privacy rights of others.
- Attempt to gain unauthorized access to the Service, other accounts, or workspaces you are not a member of.
- Interfere with or disrupt the Service, including by introducing malware or placing an unreasonable load on our infrastructure.
- Resell or redistribute the Service without our prior written consent.
6. Third-party services
The Service integrates with third-party services, including Google Calendar. Connecting a third-party account is optional and subject to that provider's own terms and privacy policies. Our use of information received from Google APIs is described in our Privacy Policy and adheres to the Google API Services User Data Policy, including its Limited Use requirements. You can disconnect an integration at any time from the Settings page.
7. Availability and changes
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may suspend or modify the Service, in whole or in part, for maintenance, security, or operational reasons.
8. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You use the Service at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us for the Service in the twelve months preceding the claim, or 100 USD if you have not paid us anything.
10. Termination
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends; provisions that by their nature should survive (including Sections 8, 9, and 11) will survive.
11. General
These Terms constitute the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, notify you through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
